The Ninth Spur is preparing a constitutional challenge concerning the use of automated license plate reader (ALPR) networks, including Flock Safety camera systems, based on concerns that the widespread collection, retention, and sharing of citizens' travel data may infringe upon rights protected by the Fourth Amendment.
The proposed action is intended to be brought under 42 U.S.C. § 1983 and will seek declaratory and injunctive relief rather than monetary damages. The purpose of the litigation is to obtain judicial review regarding whether these surveillance practices comply with the protections guaranteed by the United States Constitution and, where appropriate, to prevent unconstitutional government surveillance.
This initiative is informed by constitutional principles discussed in cases involving prolonged government surveillance, including Leaders of a Beautiful Struggle v. Baltimore Police Department, while recognizing that every legal challenge depends on its own facts and the applicable law.
The Ninth Spur believes that public safety and constitutional liberty are not mutually exclusive. Effective law enforcement and the protection of individual rights should exist together within the framework established by the Constitution.
